These Terms of Service govern the use of the Promenade Lighting website and purchases made through it. Promenade Lighting is a brand of Promenade Engineering LLC.

“Promenade Lighting,” “we,” “us,” and “our” refer to the operator of this store. “You” and “your” refer to a website visitor or customer.

By visiting this website or placing an order, you agree to these Terms of Service and the policies linked from the website, including our Privacy Policy and Refund Policy.

  1. ELIGIBILITY AND ACCEPTABLE USE

You represent that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian to use this website.

You may not use the website or its content for unlawful, fraudulent, abusive, or harmful purposes; attempt to interfere with its security or operation; transmit malicious code; scrape or reproduce content in violation of applicable law; or violate the rights of Promenade Lighting or any third party.

  1. PRODUCT INFORMATION

Promenade Lighting makes reasonable efforts to describe and photograph its products accurately. Screen settings, lighting, manufacturing variations, and the characteristics of a selected finish can affect how colors and textures appear. Product dimensions identified as approximate may vary within reasonable manufacturing tolerances.

The Kyoto Lamp is supplied unassembled and requires customer assembly as described in the instructions. Customers should read and follow the supplied Assembly Guide and User Guide before use.

Finish names—including Natural Maple, Prairie Pine, Mission Walnut, Heritage Cherry, Classic Rosewood, and Rich Ebony—identify colors or finishes. They do not state or imply that a product is made from those species of wood. Products are made from wood PLA, PLA, or PETG filaments.

We may correct typographical errors or inaccurate product information. If a material correction affects an unfulfilled order, we will contact the customer when reasonably necessary.

  1. PRICES, PAYMENT, AND TAXES

Prices are shown in the currency displayed at checkout and may change without notice. The price charged for an order is the price displayed when the order is submitted, subject to correction of an obvious error.

Applicable taxes, shipping charges, customs duties, brokerage fees, and other charges are shown or described during checkout when available. International customers are responsible for import duties, taxes, brokerage fees, and similar governmental charges unless applicable law requires otherwise.

Payment must be authorized before an order is accepted. Product availability, receipt of an order confirmation, or payment authorization does not require Promenade Lighting to accept an order affected by fraud, an obvious error, an unavailable item, or a legal or operational restriction.

If an order is declined after payment has been captured, the captured amount will be refunded.

  1. ORDERS AND CANCELLATIONS

We may limit or refuse an order when reasonably necessary to address suspected fraud, pricing or listing errors, product availability, shipping restrictions, or applicable law.

An order may be canceled for a full refund until a shipping label has been produced.

To request cancellation, email support@promenadelighting.com as soon as possible and include your order number. Cancellation requests require confirmation from Promenade Lighting and are not automatic. Once a shipping label has been produced, the order can no longer be canceled. There is no cancellation fee for an approved cancellation.

  1. SHIPPING AND DELIVERY

Available shipping methods, charges, and estimated delivery information are presented at checkout when available. Delivery dates are estimates unless expressly stated otherwise.

Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect address, refusal of delivery, or failure to collect a shipment may be charged to the customer where permitted by law.

The carrier’s delivery record establishes the delivery date for the limited-warranty period. Shipping damage must be reported immediately under the Refund Policy, preferably within 48 hours of carrier-recorded delivery.

  1. RETURNS, REFUNDS, SHIPPING DAMAGE, AND WARRANTY

Eligible returns may be requested within 30 days of confirmed delivery, subject to the conditions and exclusions stated in the Refund Policy.”

Returns, refunds, shipping-damage claims, the one-time initial-assembly replacement, and the one-year limited warranty are governed by the Refund Policy published on this website. That policy is incorporated into these Terms of Service.

  1. SAFE USE AND CUSTOMER RESPONSIBILITIES

Use products only as described in the supplied documentation.

Do not modify the wiring, RF controller, Lamp Core, LED strip, power connections, or other electrical components. Use only the supplied power adapter unless Promenade Lighting provides an approved replacement.

Disconnect power before assembly, cleaning, removing panels, opening the base cover, or inspecting an internal connection.

Products are intended for indoor, dry-location use unless a product page expressly states otherwise.

  1. INTELLECTUAL PROPERTY

The Promenade Lighting name, product designs, photographs, graphics, written content, manuals, logos, and other original materials are owned by Promenade Engineering LLC or used with permission. These materials are protected by applicable intellectual-property laws.

No ownership rights are transferred through access to the website or purchase of a product.

Customers may use product manuals for personal use with the purchased product. Protected content or product designs may not be reproduced, distributed, sold, reverse engineered, or commercially exploited except as permitted by law or with written permission.

  1. THIRD-PARTY SERVICES AND LINKS

This store is hosted by Shopify and may use third-party services for payment processing, shipping, analytics, video, and other functions. Third-party services may be governed by their own terms and privacy practices.

Links to third-party websites are provided for convenience. Promenade Lighting and Promenade Engineering LLC are not responsible for the content, security, availability, or operation of third-party websites.

  1. DISCLAIMER AND LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the website and its content are provided without warranties beyond those expressly stated in the published product documentation and policies.

To the fullest extent permitted by applicable law, Promenade Lighting and Promenade Engineering LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the website or a product.

Nothing in these Terms of Service excludes or limits liability or consumer rights that cannot legally be excluded or limited.

  1. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Promenade Lighting and Promenade Engineering LLC harmless from third-party claims arising from your unlawful misuse of the website, violation of these Terms of Service, or infringement of another person’s rights.

  1. SEVERABILITY AND WAIVER

If any provision of these Terms of Service is held to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

A failure to enforce a provision does not waive the right to enforce it later.

  1. GOVERNING LAW

These Terms of Service are governed by the laws of Maryland, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Any permitted legal proceeding will be brought in Carroll County, Maryland, unless applicable law requires or permits another venue.

  1. CHANGES TO THESE TERMS

We may update these Terms of Service by publishing a revised version with a new “Last updated” date. Changes apply prospectively from publication unless applicable law requires otherwise.
